§ 1 Definitions
- Newsletter – a free service provided electronically by the Service Provider, consisting in the periodic or occasional sending to the Subscriber’s e-mail address of information concerning the Store, offer, new products, promotions, vouchers, marketing campaigns, inspirational content or other commercial information related to the Store’s activity.
- Terms and Conditions – these Newsletter Terms and Conditions.
- Store – the Mamatu online store available at www.mamatu.pl or its language version available at www.mamatushop.com.
- Subscriber – a person who has ordered the Newsletter service by providing their e-mail address through the Newsletter function available in the Store.
- Service Provider – apconcept Anna Przeracka-Byskosz with its registered office in Wrocław, ul. Kosynierów Gdyńskich 74/2, 51-687 Wrocław, Poland, NIP 9251842379, REGON 146386503.
- Consumer Rights Act – the Polish Act of 30 May 2014 on consumer rights.
§ 2 Contact with the Service Provider

- The cost of a telephone call or data transmission made by the Subscriber depends on the basic tariff of the telecommunications operator or Internet service provider used by the Subscriber.
§ 3 Technical requirements
- To subscribe to and use the Newsletter, the following are required:
- an active e-mail account,
- a device with Internet access,
- an up-to-date web browser supporting JavaScript and cookies.
- The Subscriber should use the Newsletter in accordance with the law, these Terms and Conditions and good practices.
§ 4 Newsletter
- Subscription to the Newsletter is voluntary and free of charge.
- To subscribe to the Newsletter, the Subscriber provides their e-mail address in the Newsletter form available in the Store and confirms the subscription in accordance with the messages displayed in the Store.
- Subscription to the Newsletter means conclusion of an agreement with the Service Provider for the provision of the Newsletter service for an indefinite period.
- The Newsletter may include, in particular, information about products, new arrivals, promotions, vouchers, marketing campaigns, collections, inspirational content and events related to the Store.
- The Newsletter is sent to the e-mail address provided by the Subscriber.
- The Subscriber should provide a correct and current e-mail address.
- Subscription to the Newsletter may require consent to receiving commercial information and direct marketing by electronic means, in accordance with applicable provisions, in particular the Polish Electronic Communications Law and GDPR.
- Consent to receive the Newsletter is voluntary and is not a condition for placing an order in the Store.
§ 5 Unsubscribing from the Newsletter
- The Subscriber may unsubscribe from the Newsletter at any time and without giving any reason.
- Unsubscribing from the Newsletter may be done in particular:
- by clicking the unsubscribe link, if included in the Newsletter message,
- by sending an e-mail with a request to unsubscribe to: sklep@mamatu.pl.
- Unsubscribing from the Newsletter results in termination of the Newsletter agreement and discontinuation of sending the Newsletter to the Subscriber’s e-mail address.
- Unsubscribing from the Newsletter does not affect the performance of sales contracts concluded in the Store or the possibility of using the Store.
§ 6 Complaints
- Complaints concerning the Newsletter may be submitted by e-mail to: sklep@mamatu.pl or in writing to the Service Provider’s address indicated in § 2 of these Terms and Conditions.
- The complaint should include data enabling identification of the Subscriber, a description of the problem concerning the Newsletter and the Subscriber’s request.
- The Service Provider responds to the complaint within 14 days from the date of its receipt.
- No provision of these Terms and Conditions excludes or limits the Subscriber’s rights arising from mandatory provisions of law.
§ 7 Right of withdrawal from the Newsletter agreement
- A Subscriber who is a Consumer or Privileged Entrepreneur has the right to withdraw from the Newsletter agreement within 14 days without giving any reason.
- The withdrawal period expires after 14 days from the date of conclusion of the Newsletter agreement.
- To exercise the right of withdrawal, the Subscriber should inform the Service Provider of their decision by means of an unequivocal statement, for example by e-mail or in writing, using the contact details indicated in § 2 of these Terms and Conditions.
- To meet the withdrawal deadline, it is sufficient to send the statement before the withdrawal period expires.
- The Subscriber may use the model withdrawal form attached as an appendix to these Terms and Conditions, but this is not mandatory.
- Regardless of the right of withdrawal, the Subscriber may unsubscribe from the Newsletter at any time in accordance with § 5 of these Terms and Conditions.
§ 8 Personal data
- The controller of the Subscriber’s personal data is the Service Provider.
- The Subscriber’s personal data are processed in particular for the purpose of providing the Newsletter service, sending commercial information and direct marketing, handling unsubscribe requests, fulfilling legal obligations and establishing, pursuing or defending claims.
- The legal basis for processing personal data is in particular the Subscriber’s consent, performance of the Newsletter agreement, a legal obligation imposed on the Service Provider and the Service Provider’s legitimate interest.
- Providing an e-mail address is voluntary but necessary to subscribe to and receive the Newsletter.
- The Subscriber may withdraw consent to receive the Newsletter at any time, without affecting the lawfulness of activities carried out before its withdrawal.
- Data will be processed for the period of using the Newsletter and thereafter for the period required by law or necessary to demonstrate consent, establish, pursue or defend claims.
- Detailed information on the processing of personal data is available in the Privacy Policy available in the Store.
§ 9 Amendments to the Terms and Conditions
- The Service Provider may amend these Terms and Conditions for important reasons, in particular in the event of changes in law, changes in Newsletter functionality, changes in the Service Provider’s data or the need to clarify the provisions of these Terms and Conditions.
- The Service Provider will inform the Subscriber of an amendment to these Terms and Conditions by publishing the new version in the Store or by e-mail, if required by the nature of the amendment.
- A Subscriber who does not accept amendments to these Terms and Conditions may unsubscribe from the Newsletter at any time.
§ 10 Final provisions
- The Newsletter agreement is concluded in English.
- The Newsletter agreement is governed by Polish law, subject to mandatory provisions ensuring protection for the Consumer appropriate to their habitual place of residence, if such provisions apply.
- These Terms and Conditions are available free of charge in the Store in a way that enables them to be obtained, reproduced and recorded.
- These Terms and Conditions enter into force on 19 June 2026.
Appendix No. 1 – model withdrawal form for the Newsletter agreement
This form may be used if you wish to withdraw from the Newsletter agreement, but using it is not mandatory.
